Litigation - An Extension Turfgrass Management Specialist's Perspective.

Thomas Samples, John C. Sorochan, and J. Scott McElroy. University of Tennessee, 2431 Joe Johnson Drive, 252 Ellington Plant Sciences Bldg., Knoxville, TN 37996-4561

In addition to developing educational programming for county extension personnel and turfgrass industry professionals, university turfgrass management specialists may occasionally be required to provide expert testimony during civil and criminal trials. Testifying in depositions and court proceedings under penalty for failure to attend is often very stressful and can compromise professional relationships and friendships. Example cases involving 1) a turfgrass-sod producer and a turfgrass seed supplier; 2) greens damage resulting from a contaminated pesticide; 3) a golf course owner and greens vandalism; and 4) a turfgrass-sod producer and an insurance company representative will be discussed in an effort to demonstrate specific challenges and difficulties associated with a specialist's involvement in in-state litigation.
